These Terms and Conditions ("Terms") govern your access to and use of the Kale mobile application and services ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Using Our Service

You must be at least 13 years old to use the Service. You are responsible for your use of Kale and for any content you provide, including compliance with applicable laws, rules, and regulations.

Our goal is to create a more genuine and positive social space. We are "social media without the cocaine." This means we are a platform for friends, not for influencers, endless reels, or harmful content.

2. Your Account

To use our Service, you must create an account using your phone number. You agree to provide us with accurate and complete information. You are responsible for safeguarding your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Content on Kale

You are responsible for your content. You retain your rights to any content you submit, post, or display on or through the Service. By submitting content, you grant Kale a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.

We reserve the right to remove content that violates these Terms, including but not limited to:

• Illegal, hateful, or abusive content.
• Content that infringes on any intellectual property rights.
• Spam, unauthorized commercial communications, or harassment.
• Content that promotes violence, self-harm, or discrimination.

4. Prohibited Conduct

You may not do any of the following while accessing or using the Service:

• Access, tamper with, or use non-public areas of the Service.
• Probe, scan, or test the vulnerability of any system or network or breach any security measures.
• Scrape the Service or otherwise attempt to access data without our express written permission.
• Interfere with, or disrupt, the access of any user, host, or network.
• Impersonate or misrepresent your affiliation with any person or entity.

5. Termination

You can stop using our Service and delete your account at any time. We may also suspend or terminate your account at our sole discretion, without notice, for any conduct that we believe violates these Terms or is otherwise harmful to other users or the Service.

6. Disclaimers and Limitation of Liability

The Service is provided "AS IS" without any warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

7. Governing Law

These Terms and any action related thereto will be governed by the laws of the State of Delaware, without regard to its conflict of laws provisions.

8. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be on this page. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.
